FSSAI Registration
FSSAI Registration/ FSSAI License is commonly known as Food License or Food Registration. Fssai Registration is applicable to every person or business entity which is carrying Food Business also known as Food Business Operators (FBOs) in any form like food processing, food manufacturing, food packaging, food Re-packaging, food Re-labelling, Food vending, distributing, or selling, reselling, Importing, Exporting, Restaurants, Hotels, Club, Canteen, Caterer, Food Storage, E-commerce etc.
The registration/licence is issued by the Food Safety and Standards Authority of India (FSSAI), through FoSCos (Food Safety Compliance System). FSSAI is an independent organization which is established by the Ministry of Health & Family Welfare, Government of India. It was formed in August 2011 under the provisions of the Food Safety and Standard Act, 2006. It was in association with the Ministry of Health and Family Welfare, as well as the Central government.

Types of FSSAI Licence in India
According to the Food Safety and Standard Act, 2006 there are three categories of FSSAI Registration/License, the maximum tenure for Registration/License is 5 years and the minimum is 1 year.
FSSAI Registration – Basic
It is the primary kind of registration issued for businesses which are very small. If the annual turnover of the business is less than 12 lakhs, then the food business operator shall get FSSAI Registration.
Dairy having capacity less that 500 liters per day or daily manufacturing capacity less than 100kg per day needs to get basic FSSAI registration which includes wide range of businesses starting from small pan shops, tea stalls, home based food operators, small warehouses, canteen’s , mid-day meal services and food processors.
Fee for FSSAI Registration is very nominal which is Rupees 100/- Per year.
FSSAI State Licence
If the annual turnover of the business is between 12 to 20 crores then the food business operator shall apply for State license.
Manufacturing units having capacity upto 2 MT per day, Dairy units handling business upto 50000 liters per day, 3 star hotels and above, repackers and relebelling units, clubs canteens, all the catering business irrespective of their turnover needs to apply for State licence.
Fee for FSSAI State Licence is varies between Rupees 2000/- to 3000/- Per year.
FSSAI Central Licence
If the annual turnover of the business is above 20 crores, then the food business operator shall apply for Central License.
Businesses which do not fall under the above two categories, they need to go for central licence, the importer and exporters mandatorily needs central licence, in case you are in a business having multiple outlets across the country then you need to go for central licence for your registered address and need to get basic state or central licences depending on the turnover of each outlet.
Fee for FSSAI Central Licence is Rupees 7500/- Per year.

FSSAI License Renewal
Every FSSAI registration or license holder can apply for the renewal of license by making an application after 180 days of obtaining FSSAI registration or license but before 30 days prior to the expiry date of the FSSAI license.
If Renewal Application is not filed before 30 days of expiry of FSSAI registration or license late fee of 100rs. Per day will be applicable till the expiry date of FSSAI registration or license. If the food business license has expired, the Food Business Operator must terminate all business activities at the premises and apply for fresh FSSAI registration or license Certificate.
Consequences for Not Having FSSAI licence
If any person or food business operator (except the persons exempted from licensing under sub-section (2) of section 31 of this Act), carry on any food business without licence/ Registration shall be punishable with imprisonment for a term which may extend to six months and also with a fine which may extend to five lakh rupees.

FSSAI Annual Return
As per FSS (Licensing and Registration) Regulations, 2011, After receiving the FSSAI registration/license, the FBOs must comply with the FSSAI compliances and file the FSSAI annual return. The FBOs must file the annual return within the prescribed time, or else they will have to pay penalties.
All the food business operators (FBOs) who hold a food license and have an annual turnover of Rs. 12 lakh should file the annual return on or before 31st May of the next Financial Year.
Who should File FSSAI Return?
- Every FBO has a business turnover of more than Rs.12 lakhs.
- FBOs who importing, selling, manufacturing, exporting, storing, distributing, handling or transporting any type of food products.
- Manufacturer and Distributor of Milk even if business T/o is less than Rs. 12 Lakhs

What are the Kinds of Annual Returns?
As per FSSAI Act there are Two kinds of FSSAI Annual Return:
FSSAI Form D1 (Annual Return)
Annual FSSAI Return is mandatorily applicable to every FBOs, food manufacturer, importers, labellers, re-labellers, packers, and re-packers, etc. in Form D1. The form D1 can be filed online or physically as provided by the food safety commissioner.
The FSSAI annual return-Form D1 should be filed on or before 31st May of every fiscal year. The form is filed with the Licensing Authority depending upon the type of food products sold by the FBO in the preceding financial year.
FSSAI Form D2 (Half-Yearly Return):
Half-Yearly Return is not mandatory for every FBOs. FSSAI license holders who are involved in the manufacturing and distribution of milk or milk products needs to file Half Yearly Returns in Form D2.
Form D2 is filled by on or before 31st October for 1st April to 30th September and by on or before 30th April for 1st October to 31st March of every financial year.
** Every FBOs should file a separate return for every license issued under FSSAI regulations, irrespective of whether the same FBO carries more than one food license unit/business. Therefore, an FBO with more than one licence should file separate returns for each FSSAI license. It is immaterial that the same FBO holds these FSSAI licenses.
Penalty for Non-Filing of FSSAI Returns:
If FBOs fails to file the FSSAI returns within the prescribed due date, a fine of Rs.100 will be imposed on them every day the default continues starting from the next day of the due date.
